Useful information regarding entitlements.
Entitlements cannot be transferred between member states or regions
within the
Entitlements can only be leased if accompanied by the corresponding
number of hectares.
Entitlements can only be leased or sold if a minimum of 80% was
used/activated by the holder in 2005. However it may be possible to activate
less than 80% and elect to immediately surrender the unused entitlements
following which you may be able to trade the activated entitlements.
FVP Entitlements can also be activated for payment on eligible land
where you are growing other crops or which is being retained in GAEC.

asked questions.
Q. Do I have to claim on all my entitlements each year?
A. No, but any which are unused during 3 consecutive
years will be withdrawn to the National Reserve. This means in order to keep
all of your entitlements live a minimum average of 33% must be used each year.
In order to trade any entitlements or authorizations you must have established
at least 80% of them in 2005 SPS claim year..
Q. I failed to register several fields
in 2005 and 2006; can I still register and claim in 2010?
A.You can register to create naked acres on any new
fields but cannot obtain entitlements on fields registered after 2005. The only
way to obtain additional entitlements is to acquire them through the market
place.
Q. I have purchased some additional land
without entitlements and would like to claim SFP what do I have to do?
A. Check the land
is registered with the Rural Land Registry if not register the land. Purchase
the number of entitlements required to cover the land 1 entitlement per hectare
and make sure if the land is Non SDA you purchase a Non SDA entitlement.
Q Can I sell part or all of my entitlements if my
entitlement allocation is made up of more than 20% of National Reserve
entitlements?
A No you must claim
on all of your national reserve entitlements for five years before you can sell
any of your entitlements.
Q Can I still claim SPS on land under fruit, vegetable
and potatoes?
A Yes, you can use
normal and national reserve entitlements to claim future SPS on such land.
Q. I am selling some land and would like to
retain the SFP income, what are my options?
A. It is possible to include clauses in a sale contract
which provide for the whole or part of the SFP (i.e., historic element) to be
paid annually to the vendor. It is however very risky. A safer option is to
sell the entitlements or to retain them and
rent in naked acres.
Q. How can I lease out entitlements?
A. Technically for one year or more with the equivalent
area of land. In practice it is possible to lease without land via what is
known as a back to back contract. In reality leasing of entitlements is rare.
Q. If I buy or lease in milk quota will the
additional litres increase my SFP?
A. No, only milk quota held at 31st March 2005 affected
your SFP. Any quota gained or lost after that date has no effect on your
payment.
Q. Do I have to sell or lease complete
entitlements or can I sell or lease parts of an entitlement to match field
areas?
A. You can trade in tenths/parts of entitlements.
Q. What is the deadline for transferring all
types of entitlements for claiming against in 2010?
A. Entitlement transfer forms (RLE1) must be received at
the Rural Payments Agency's offices by midnight 2nd April 2010.
Q. Do I
have to wait for written confirmation from the RPA that the Entitlements I have
purchased have being transferred to me before transferring them out again?
A. It is possible to submit
transfer forms involved in ‘string’ transfers this is where entitlements are
transferred to farmer A to farmer B, and farmer B immediately transfers the
entitlements to farmer C. In these
circumstances both forms can be submitted at the same time without having to
wait for the first transfer to be processed.
However, to ensure that these forms can be processed correctly all of
the RLE1 forms must be submitted together with a covering letter and string
written on top of all of the RLE1 forms.
